1. Introduction
Learning 24/7 is a brand of Training 24/7 Pty Ltd (ABN 58 616 642 070). These Terms and Conditions ("Terms") govern your use of the Learning 24/7 platform at learning247.au or any other associated domain ("the Platform").
By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.
2. Permitted Use
The Platform is provided exclusively for:
- Home learning by families for the education of their children
- Schools (primary and secondary) for classroom instruction
- Tutoring organisations for tutoring services
Any other use of the Platform requires explicit written permission from Training 24/7 Pty Ltd. Unauthorised use may result in account termination without refund.
3. Account Registration and Responsibility
3.1 Eligibility
You must be at least 18 years of age to create an account. By registering, you represent that you are of legal age and have the authority to enter into these Terms.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorised use of your account.
3.3 Parental Responsibility
For home learning accounts, parents, guardians, or caregivers are fully responsible for their children's use of the Platform, including any actions taken by children while using the Platform.
4. Account Sharing Prohibited
Account sharing is strictly prohibited and may result in immediate termination without refund.
4.1 Home Learning
Each child requires their own subscription. Subscriptions cannot be shared between households or with other families. One subscription covers one child for one year level of content.
4.2 Schools and Tutoring Organisations
- Teacher Accounts: Every teacher who uses the Platform must have their own staff account. Teacher accounts cannot be shared between staff members.
- Student Access: Every student who will access the Platform directly (via tablet, laptop, phone, or any other device) must have a student subscription allocated to them. Student access links cannot be shared between students.
4.3 Monitoring and Enforcement
We monitor for signs of account sharing, including simultaneous logins from different locations. Evidence of account sharing will result in immediate termination of the account and forfeiture of any remaining subscription period without refund.
5. Intellectual Property and Content Rights
5.1 Ownership
All content on the Platform, including but not limited to videos, slides, worksheets, resources, teaching materials, graphics, text, and software, remains the exclusive property of Training 24/7 Pty Ltd. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the content solely as described in these Terms.
5.2 Slides and Presentation Materials
Our slides and presentation materials:
- May only be viewed through the Platform's protected viewer
- Cannot be downloaded, saved locally, or stored on any device
- Cannot be printed, photocopied, or reproduced in any form
- Cannot be captured in screenshots, screen recording, or by any other means
- Cannot be used after your subscription ends
Any use of slides or presentation materials outside of these terms requires explicit written permission from Training 24/7 Pty Ltd.
5.3 Downloadable Resources (PDFs, Worksheets)
For PDF resources and worksheets that are made available for download:
- Home Learning: Resources may be printed for use by subscribed children within the household only
- Schools: Resources may be photocopied for use by licensed teachers and their subscribed students only. Resources may be stored on a local school file server for the duration of the subscription, provided access is restricted to staff and students with active subscriptions
- Prohibited: Resources cannot be shared on the internet, posted publicly, distributed to non-subscribers, or shared with anyone outside of your subscription coverage
5.4 Videos
Video content may only be streamed through the Platform. Videos cannot be:
- Downloaded or saved locally
- Screen recorded or captured in any form
- Used for public performance outside of a classroom setting
- Shared via any means
5.5 Prohibited Actions
You must not:
- Screen record, screenshot, or capture any slides, videos, or content
- Use any content for public performance except within a classroom between teacher, support officers, and students for educational purposes
- Reverse engineer, decompile, or attempt to extract source code from the Platform
- Circumvent or attempt to circumvent any security measures or access controls
- Republish, redistribute, or make available any content to third parties
- Use content to create derivative works or competing products
5.6 Licence Termination
Your licence to use our materials terminates immediately when your subscription ends. Upon termination, you must cease all use of our content and delete any downloaded resources from your devices and storage systems.
6. Subscriptions and Pricing
6.1 Pricing
All prices are displayed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change our pricing at any time. Price changes will not affect existing paid subscriptions until renewal.
6.2 Payment Processing
Payments are processed securely through Stripe. By subscribing, you authorise us to charge your payment method for the subscription fees.
6.3 Subscription Period
Home learning subscriptions are typically annual. Organisation subscriptions may vary. Access to content is provided for the duration of your paid subscription period.
7. Free Trials
We may offer free trial periods at our discretion. During a trial:
- All Terms and Conditions apply in full, including intellectual property restrictions
- Trial accounts have the same content restrictions as paid accounts
- Upon trial expiry, you must cease using all Platform content unless you convert to a paid subscription
- Any content downloaded during the trial must be deleted if you do not subscribe
We reserve the right to limit or revoke trial access at any time and to exclude any person or organisation from trial eligibility.
8. Refunds
8.1 30-Day Money-Back Guarantee
If you are not satisfied with your subscription, you may request a full refund within 30 days of your first paid subscription on the Platform. This guarantee:
- Applies only to first-time paying subscribers
- Covers the first 30 days from your initial paid subscription start date
- Does not apply to subsequent payments, renewals, or re-subscriptions
- Covers only money actually paid by you (excluding referral discounts or credits)
If you cancel and later re-subscribe, the 30-day guarantee does not reset. The guarantee period is calculated from your original first payment date.
8.2 Refund Request Process
To request a refund, you must submit a written request to support@learning247.au within the 30-day period, including your account email and reason for the refund.
8.3 Refund Limitations
- Refunds are limited to amounts actually paid by you. Any referral discounts or credits applied to your purchase will be deducted from the refund amount.
- Refunds beyond 30 days are at the sole discretion of Training 24/7 Pty Ltd.
- Accounts terminated for violation of these Terms are not eligible for refunds.
- Upon receiving a refund, your access to the Platform will be immediately terminated and you must delete any downloaded resources.
9. Referral Program
9.1 How It Works
Existing subscribers may refer new customers using their unique referral code. When a new customer signs up using a valid referral code:
- The referred person receives an instant discount on their subscription
- The referrer may receive a credit, subject to the conditions below
9.2 90-Day Rule
For the referrer to receive their referral credit, the following conditions must be met 90 days after the referred person's initial payment:
- The referrer must have an active, paid subscription
- The referred person must have an active, paid subscription (not a trial)
- The referred person must have been a paying customer for at least 90 consecutive days
- The referred person's payment must not have been refunded
If any of these conditions are not met, the referral credit will not be issued.
9.3 Referral Code Eligibility
To receive a referral code that you can share, you must:
- Have an active, paid subscription (not a trial)
- Have been a paying customer for at least 31 consecutive days
This ensures that referrers have experienced the platform and passed their own money-back guarantee period before referring others.
9.4 Referral Program Restrictions
- Self-referrals are not permitted
- Referral codes cannot be posted publicly on coupon or discount websites
- We reserve the right to modify or terminate the referral program at any time
- We reserve the right to void referral credits obtained through fraud or violation of these Terms
10. One Account Per Person Policy
10.1 Single Account Requirement
Each person is entitled to only one account on the Platform. Creating multiple accounts using different email addresses or identities is prohibited.
10.2 One Trial Per Person
Free trials are limited to one per person. You may not create a new account to obtain an additional free trial after your initial trial has expired or been converted to a paid subscription.
10.3 Prohibition on Re-subscription for Benefits
You may not cancel your subscription and re-subscribe under a different account to:
- Obtain a new free trial
- Benefit from referral discounts as a "new" customer
- Circumvent any account restrictions or limitations
10.4 Enforcement
We actively monitor for and investigate suspected violations of this policy. Violations may result in:
- Immediate termination of all associated accounts without refund
- Forfeiture of any credits, discounts, or benefits obtained
- Permanent ban from the Platform
11. Termination
11.1 Termination by You
You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period, and you will retain access until that time.
11.2 Termination by Us
We may suspend or terminate your account immediately, without notice or refund, if you:
- Violate these Terms, particularly regarding account sharing or intellectual property
- Engage in fraudulent or illegal activity
- Abuse the Platform or its users
- Fail to pay subscription fees
11.3 Effect of Termination
Upon termination, your right to access the Platform and use any content ceases immediately. You must delete all downloaded resources and cease using any materials from the Platform.
12. Disclaimers and Limitations
12.1 Service Availability
We strive to maintain Platform availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
12.2 Educational Outcomes
While our content is developed by educational experts and aligned with curriculum standards, we do not guarantee specific educational outcomes. Results depend on many factors including student engagement, consistency of use, and individual learning needs.
12.3 Limitation of Liability
To the maximum extent permitted by law, Training 24/7 Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by email. Your continued use of the Platform after changes take effect constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia, and the applicable laws of the Commonwealth of Australia. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
